With over two decades of experience, Mark Brookstein provides clients with clear, effective solutions to their litigation and employment challenges, whether a business relationship gone awry or a dispute with a former employee. Focusing on commercial litigation and employment law, Mark enjoys a diverse practice across a broad spectrum of industries. In addition to litigating matters involving contracts, real estate, business torts and other commercial disputes, Mark regularly advises employers on matters such as regulatory compliance, employee issues and protection of proprietary information.

As a litigator and employment attorney, Mark provides trusted business counsel to further Gould & Ratner’s philosophy of understanding a client’s overall strategic goals. Some recent matters include:

  • Obtaining dismissal of OSHA retaliation claim by former employee against manufacturer of semi-trailers 
  • Resolving California Prop 65 claim against nationwide ingredient distributor
  • Enforcing restrictive covenant agreement on behalf of metal casting foundry

Because the best litigation strategy is often to avoid it, Mark regularly engages in alternative dispute resolution to reduce risk and cost to clients. When litigation is unavoidable, Mark has the practical experience of trying cases in state, federal and arbitral forums.

Mark also leads the Litigation Practice's appellate practice and has won appeals on both the state and federal levels, most recently in the Illinois Supreme Court, Acuity v. M/I Homes, 2023 IL 129087.
